Access to Justice & Human Rights at UNDP July, 2020

BACKGROUND

Tanzania aspires to become a middle-income country by 2025 through a push for increased industrialization for economic transformation and human development. In doing so, the government underlines the importance of good governance and the rule of law, as well as peace and stability, in creating wealth and sharing benefits, emphasizing that people must be empowered to hold leaders and public servants accountable for their performance (Tanzania Development Vision 2025). In working with Tanzania to achieve this aspiration, the UN combined, and UNDP as the main agency in this outcome, brings a strong record of supporting the country to improve democratic governance, through specialized expertise and international good practices and networks.
The United Nations Development Assistance Plan (UNDAP II) is a successor business plan of 20 UN agencies, funds and programmes in Tanzania for the period 2016-2021. The five-year plan supports the achievement of the international development goals including the Sustainable Development Goals (SDGs), national development priorities including the FYDP II, and the realization of international obligations including human rights, UPR and Treaty body recommendations. The programme focuses on strengthening country systems, policies and processes for the fulfilment of human rights and pro-poor growth. Four Thematic Results Groups (TRGs) have been established including on Sustainable and equitable Growth; Democratic Governance, Human Rights and Gender Equality; Healthy Nation and Resilience. In addition, there is the Zanzibar Coordination Group. The TRGs are the interagency groups responsible for the coordination of the implementation of the agreed twelve (12) UNDAP II outcomes. The Governance TRG has three Outcome groups namely;
  • Democratic Governance, human rights and gender equality led by UNDP
  • Women’s political participation and leadership led by UNWOMEN
  • Violence against women and children, led by UNICEF
UNDP is leading the Outcome group on Democratic Governance, Human Rights and Gender Equality. Each Outcome Group is a UN Forum for: Discussion and provision of technical guidance; Interfacing with relevant government line ministry/sector; Linking the UN Outcome groups with other relevant sector dialogue structure, for e.g. DPGs; Developing UN joint response of critical issues relevant to the outcome group; Promoting Joint efforts: implementation, resources mobilization and advocacy; and demonstrating the engagement of Zanzibar and the UN Non-Resident Agencies (NRAs) in the discussions and deliberations.  The UNDAP II Democratic Governance, Human Rights and Gender Equality Outcome group consists of focal persons from ten (8) participating UN Agencies, including the ILO, IOM, UN Women, UNDP, UNESCO, UNFPA, UNICEF and OHCHR.
In addition to supporting the implementation of the UNDAP II, UNDP’s interventions in Tanzania, are fully aligned with the 2030 Agenda for Sustainable Development that promotes, among others, the realization of human rights of all and emphasizes the need to promote gender equality, reduce factors perpetuating inequalities, promote peaceful and inclusive societies and, access to justice for all through effective and accountable institutions. The Government of Tanzania has adopted national development priorities which reinforces the achievement of the SDGs as evident in a number of significant policy strategies, including the Medium-Term Strategy (MTS) and Action Plan; the National Human Rights Action Plan (NHRAP); the Judiciary Strategic Plan (JSP) 2015–2020; and the Child Justice Five Years Strategy (CGFYS) 2013-2017. Over the past 10 years, the Government with support from development partners has embarked on several strategic initiatives which have been designed to reform the legal and justice sector and strengthen human rights’ promotion and protection mechanisms for the most marginalized groups of the society, particularly women and children.
In this vein, the Access to Justice and Human Rights Programme contributes to Output 2 of the Country Programme Action Plan (2016 – 2020) in pursuing initiatives which contributes to citizens enjoying “improved access and are better served by the justice system and human rights reporting.” To achieve this result, the Programme has two active projects which are being implemented on the Mainland and in Zanzibar while pipeline initiatives are being developed. The institutions involved in the implementation of the Programme include the Ministry of Constitutional and Legal Affairs (MoCLA) as Implementing Partner (IP) and the following as responsible parties (RP): The Commission for Human Rights and Good Governance (CHRAGG), and the National Prosecution Service (NPS).
UNDP Tanzania now seeks a Technical Specialist to provide technical advisory and management services to the Access to Justice and Human Rights Programme as well as coordinate the Governance, Human Rights and Gender Equality Outcome Group

DUTIES AND RESPONSIBILITIES

Reporting directly to the Deputy Resident Representative the Technical Specialist will provide strategic and technical advice to justice sector institutions and counterparts to advance justice sector reform, promoting the realization of human rights and in enhancing access to justice. The Technical Specialist will work closely with the Programme Specialist/Team Leader of the Inclusive Democratic Governance Pillar, the CTA of the Legislative Support Project, the technical Specialist PVE Programme and the Development Management Specialist. The Technical Specialist will supervise and be supported by a National Programme Coordinator based in Zanzibar and be provided with logistical and administrative support by staff from UNDP Country Office.
Working in close cooperation and collaboration with the Democratic Governance, Human Rights and Gender Equality Outcome Lead, the Technical Specialist will contribute to the development, implementation and management of the joint work of the Outcome Group on Democratic Governance, Human Rights and Gender Equality under the United Nations Development Assistance Plan II (UNDAP II) for 2016-2022. As part of such duties, the Technical Specialist will engage with national counterparts, as well as UN agencies, development partners and NGOs. S/he will collaborate with the National Bureau of Statistics (NBS) to support data collection on Governance and particularly SDG 16 and other major actors in this area, as well as supporting increased engagement of the United Nations in the Development Partners’ Working Group on Democratic Governance.
  • Ensure the coordination of the Governance Outcome Group, through supporting the Outcome Lead, and promote consensus building among members of the Outcome Group
  • Provide high-level technical advice to effectively influence and design a coordinated justice sector reform strategy;
  • Provide high-level technical advice and expertise to MoCLA and other justice and human rights institutions in both Zanzibar and on the Mainland on institutional strategic planning and capacity building;
  • Provide strategic and technical direction to the UNDP the Access to Justice and Human Rights Programme;
  • Effective Knowledge Management.
  • Resource mobilization and partnership building
Ensure the coordination of the Governance Outcome Group, through supporting the Outcome Lead, and promote consensus building among members of the Outcome Group.
  • Provide advice on enhanced operational level coordination, including ensuring that meeting proceedings are recorded and are of high quality
  • Provide advice and share good practices on effective coordination in developing Joint Work Plans, implementation, monitoring, reporting and evaluation. Where appropriate, provide capacity building training to different agencies to produce quality and results oriented reports.
  • Provide technical advice to the Outcome lead in consolidating UNDAP II annual and final narrative reports provided by different agencies
  • Advise on UN alignment with national priorities and best international practices where appropriate, advise on how best the UN programming principles are mainstreamed in the Outcome group’s processes, roles and responsibilities and joint programmes in line with UN DaO guidelines.
  • Promote harmonization and cohesion among UN agencies active in the Outcome Group, by ensuring synergies, complementarity and consistency across initiatives from participating Un agencies. Strengthen relationships to cooperate and coordinate in the planning and implementation of activities of the Outcome Group.
  • Advise on quality engagement with Human Rights Institutions and civil society organisations, including the Commission for Human Rights and Good Governance (CHRAGG) and ensure that gender equality is mainstreamed in all joint programmes and projects
Provide high-level technical advice to effectively influence and design a coordinated justice sector strategy:
  • Provide leadership on UNDP efforts to influence and carry forward comprehensive justice sector reforms in both Zanzibar and on the Mainland engaging with MoCLA and other justice and human rights institutions, civil society organizations and other relevant actors;
  • Conduct thorough and high-quality research and analysis of the justice sector, identifying priority reform areas;
  • Provides timely and context-specific technical advice on emerging strategic policy issues including access to justice, legal aid, SDG 16+, human rights and institutional performance;
  • Design and develop policy/options papers and proposals to enable justice sector reform and improved justice service delivery at all levels;
  • Propose strategic approaches and priorities for reform implementation, including the definition of baselines, capacity assessment, gender analysis, performance indicators and monitoring and evaluation;
  • Develops pilot initiatives for functional partnerships between justice sector institutions, UN agencies, donor and funding agencies and non-governmental organisations, local media and the public etc.;
  • Effectively coordinate partnerships with other development partners, justice institutions on overall justice sector reform.
Provide high-level technical advice and expertise to MoCLA and other justice and human rights institutions on institutional strategic planning and capacity building, leading and implementing relevant areas of the UNDP Rule of Law and Access to Justice Workplan:
  • Lead, oversee and implement areas of the UNDP the Access to Justice and Human Rights Workplan providing technical assistance to the implementation of strategic plans, programme strategies, action plan and work plans;
  • Lead, oversee and implement training and capacity development initiatives on relevant thematic areas in reinforcing capacity for functional effectiveness and justice and human rights service delivery;
  • Provide effective skills transfer and capacity development to MoCLA and other justice and human rights institutions on selected thematic areas through study tours, south-south cooperation, training and briefing sessions;
  • Provide strategic advice and mentoring to senior level justice officials as required.
Provide strategic and technical direction and oversight to the UNDP Rule of Law and Access to Justice output:
  • Under the direction of the Programme Specialist, Democratic Governance, lead the development of the strategic vision for the MoCLA and other justice and human rights institutions of the Inclusive Democratic Governance Programme in a post-election context;
  • Prepare research documents and inputs to inform the direction of the new Country Programme Document (from 2021) as it pertains to Legal aid, Access to Justice and Human Rights;
  • Proposes ways to ensure that UNDP’s Access to Justice and Human Rights activities are better linked as part of efforts to bridge gaps in justice and human rights services between formal and informal mechanisms, union, regional and grassroots levels etc.;
  • Provides inputs into the development of regional and state justice strategies for the Access to Justice and Human Rights programme;
  • Integrates and promotes a human rights-based approach to the rule of law, ensuring the mainstreaming of initiatives for the promotion and protection of human rights and gender equality;
  • Contribute to the preparation of Terms of Reference and design for such events as training (curricula, courses, schedules), study tours, conferences and workshops, and to advise UNDP on the joint approval and sign-off of these documents;
  • Contribute to the formulation/improvement of an effective monitoring and evaluation system of the output and reports on progress, including reporting to UNDP, development partners and national stakeholders on progress;
  • Effectively coordinates with other UN agencies who work on justice issues (UNICEF, UNHCR, UNODC, OHCHR, UN Women) to develop inter-agency synergies
Effective Knowledge Management:
  • Produces at least one knowledge product on governance, human rights, justice sector /rule of law/legal sector reform and/or access to justice in both Zanzibar and on the Mainland per year;
  • Raises visibility of the Access to Justice and Human Rights Programme strategies through knowledge sharing and well-developed communication materials;
  • Shares Programme results including through reviewing Programme publications, and by taking responsibility for knowledge networking with national agencies and UNDP’s global community.
Resource Mobilization and Partnerships
  • Take the lead in identifying funding opportunities for the Access to Justice and Human Rights Programme, listing them and sharing the information with the Governance Unit and SMT.
  • Support and provide a technical lead in the processes of developing funding proposal which shall involve writing project and budget plan proposals and coordinating with different institutions and groups with the aim of promoting effective design and where necessary joint proposal submissions.
  • Assist in developing a resource mobilization plan and constantly follow-up the implementation of the plan including through designing and writing materials for communications with different prospective donors and agencies.
  • Assist in mobilizing non-financial resources from private sectors entities, individuals and corporate agencies.

REQUIRED SKILLS AND EXPERIENCE

Education:
  • Master’s Degree in Law or equivalent advanced Degree in a related field of expertise, such as international law, human rights law, political science, public administration, development studies, international affairs is required. Degree in law and/or human rights is an asset.
Experience:
  • At least 7 years’ professional experience and demonstrated understanding of governance / rule of law / justice, human rights, justice sector reforms related-work and related fields such as legal aid and access to justice is required. Prior advisory experience in one or more of these sectors is required;
  • Knowledge of the Standard Operating Procedures (SOPs) for Delivering as One (DaO) and technical expertise related thereto an asset;
  • Experience in coordination and design/implementation of rule of law/ good governance / Human Rights projects and Joint Programmes, demonstrated expertise on coordination and designing of rule of law/governance projects.
  • Understanding of United Nations’ policy and programmatic approaches, including Results Based Management and Human Rights Based Approach to Development;
  • Knowledge of cross-cutting issues, including gender equality, human rights and Sustainable Development Goals;
  • Proven experience in the project management including design, management, implementation, monitoring and evaluation with strong project reporting skills of development assistance projects and/or working in a relevant position to this post
  • Proven ability to conceptualize, develop, and plan as well as transfer knowledge and skills.
  • Experience working with or in international and donor organizations with implementation of participatory programmes and reporting on donor funded projects.
  • Extensive experience in managing multidisciplinary teams
Language Requirements:
  • Proficiency in English. Working knowledge of other UN language desirable.
  • Knowledge of Kiswahili is an asset
